A historical moment – the ACT has become the first Australian state to legalise growing, possessing, and using cannabis for personal use.
It comes after a long campaign by multiple parties throughout the ACT and Australia, but it’s finally official.
You can now smoke cannabis for personal use legally in the capital city of Australia. Not only that, but the new state laws also permit each household to grow up to four plants and possess 50g of dried cannabis.
It’s a monumental moment for the complete legalisation of cannabis in Australia, a telling sign of what’s to come for the other Australian states lagging behind.
Key points from the new legislation:
- Maximum of two (2) plants per adult, maximum of four (4) per household
- Maximum of 150g of “wet” cannabis, maximum of 50g dried cannabis
- Supply and sale of cannabis is still illegal and a criminal offence
- Hydroponic setups are still illegal
- Plants must not be accessible by children or the public
One question being asked by many experts, is how newly-legalised cannabis growers are to source their seeds or baby plants – both still in the grey area of the law.
Another question being pondered, is whether federal agencies would step in and counteract the law, as the Federal Legislation still mentions of all the above as being an offence.

States will make their own decisions according to priorities and complexions of their own government and that is up to them.
However, he still expects “federal law enforcement agencies to press the law”.
Many states, politicians, and industry experts will be watching closely as to how the new laws are perceived by the residents of ACT and whether the legislation will result in a net benefit or not.
